A German appeals court has found in favour of EFI in a patent lawsuit brought about by Durst. The result follows the initial case in 2009, which also agreed with EFI.
The case centred on a utility model – intellectual property protection similar to a US patent – filed by Durst in 2007, which EFI states concerns technology that it had used 'well before' Durst's utility model application. The German court has now confirmed the Durst invention in question is not novel.
EFI's general counsel Bryan Ko says the company is 'pleased' with the outcome.
